Oterra Privacy Policy

This Policy is in accordance with the Privacy Act 1988 (Cth) and  describes the type of personal information Oterra Capital P/L and Oterra Capital Management P/L “Oterra” collects, and our policies and practices for collecting, handling, storing, using and disclosing personal information. Oterra may also provide you with additional information about how Oterra will use your personal information at the time that it is collected.

How does Oterra collect personal information

Oterra collects personal information so that Oterra can provide you with our products and services and comply with our legal and regulatory requirements. Oterra primarily collects this information when you transact with us, when you access the Oterra website operated by us and when you communicate with our staff.

In most cases, Oterra collect your personal information directly from you. However, Oterra may also collect your personal information from other sources such as your accountant or financial adviser. In addition, Oterra may collect personal information about individuals who are not clients of Oterra in our dealings with them.

What personal information does Oterra collect?

Any information that identifies you is deemed to be personal information. The personal information Oterra collects from you will depend on the circumstances of collection. The type of information Oterra collects from you to be able to provide you with our products and services. Oterra is also required to ask for certain information by law. Oterra need to obtain certain information from you to comply with the requirements of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.

How does Oterra use your information?

Oterra use your personal information for our business purposes, to provide you with products and services, to manage and administer and manage the products and services, to communicate with you on an on-going basis and to comply with relevant laws and regulations. Oterra may use personal information that you provide us to improve our products and service, to verify your identity and/or to prevent fraud, crime or other activity that may cause harm.

From time-to-time Oterra may use your contact details to send you educational and marketing material about other products /Oterra offers. If you do not wish to receive these communications, you can unsubscribe by notifying us that you wish to do so.

What if you don’t provide information to us?

If you do not provide us with some or all the information that Oterra asks for, Oterra may not be able to provide you with the products and services you require.

How does Oterra store and protect your personal information?

Oterra strives to maintain the accuracy, completeness and currency of the personal information Oterra hold and to protect its privacy and security. Oterra keep personal information only for as long as is reasonably necessary for the purpose for which it was collected or to comply with any applicable legal reporting or document retention requirements.

Where data is directly input through a digital medium, it is not stored on any local servers and is protected through cloud based protocols. Oterra utilise a range of technical security measures to ensure that your information is safe, including such practices as password controls, secure multi-factor authentication, encryption, firewalls and anti-virus technology.

When Oterra do not require your personal information anymore Oterra will delete, destroy or de-identify it.

Who does Oterra disclose your personal information to?

In some circumstances Oterra may disclose your personal information to persons/entities outside of Oterra, including to:

  • our external services providers who supply services to verify your identity or to validate your accounts;
  • our auditors, professional advisers and insurers;
  • our affiliates for business purposes and internal reporting;
  • those Oterra are required by law or regulation to disclose your personal information


How can you check, update or change the information Oterra is holding?

You may ask us for access to your personal information at any time.

Upon receipt of sufficient information to allow us to identify you, Oterra will tell you what personal information Oterra hold about you. Oterra will also correct, amend or delete your information if Oterra agrees it is inaccurate, irrelevant, out of date or incomplete. However, in some limited situations, Oterra may need to refuse a request. Oterra will advise you as soon as possible after your request if this is the case.

What happens if you want to complain?

If you have any concerns about whether Oterra have complied with the Privacy Act, the Australian Privacy Principles or this Privacy Policy, please send an email to: alan.poole@oterra.com.au . If you feel your complaint has not been satisfactorily addressed, or that it is taking too long to resolve, you may contact the Office of the Australian Information Commissioner (OAIC).

Other data

Oterra may use diagnostic related technology to collect, store and use anonymous data about how you access and use our website. This data is used to increase functionality and can also enable us to display information and content that is tailored to Oterra’s understanding of your interests.

Third party Websites

The Oterra website may have links to external third-party websites that may be accessed at your option by you, and that may benefit you. Oterra notes that any external websites should contain their own privacy statements and are not covered by this policy.
